Terms of Use & End-User License
1. Who we are & acceptance
MixSurface ("the app") is developed and provided from Latvia ("we", "us"). By downloading or using the app, you agree to these Terms. If you don't agree, don't use the app. Where these Terms conflict with Apple's or Google's standard end-user license for apps, the store's terms control.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, in line with the App Store / Google Play terms and these Terms. The free tier is available without purchase; additional features are enabled by a one-time, non-consumable in-app purchase ("the unlock"). You may not copy, reverse-engineer, resell, sublicense, or redistribute the app except where the law expressly allows it.
These Terms also cover the free MixSurface REAPER extension we provide for your computer, which is required for the app to work. It is licensed to you free of charge, for use only with your own licensed copy of REAPER, on the same "as is" basis as the app.
3. Purchases & refunds
The unlock is a one-time, non-consumable in-app purchase processed by Apple (or Google, where applicable). The price is the amount shown in the app at the point of sale, a one-time $29.99 (or the equivalent in your local currency, including any applicable tax). Prices may vary by region and change over time. Refunds are handled by the store under its own policy. We cannot issue refunds directly. You can restore the unlock on your devices through the store.
4. What MixSurface is, and is not
MixSurface is an independent control surface for REAPER, the digital audio workstation by Cockos Incorporated. It is not made by, endorsed by, affiliated with, or supported by Cockos or REAPER. "REAPER" is a trademark of Cockos Incorporated. You are responsible for your own licensed copy of REAPER and any third-party plugins you use with the app.
5. Acceptable use
Use the app only with software you are licensed to use and on networks you are authorised to use, and never for any unlawful purpose or in a way that interferes with others' systems.
6. No warranty
The app is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We don't warrant that it will be uninterrupted, error-free, or compatible with every plugin or REAPER configuration. Do not rely on the app as your sole control path in a critical live performance or recording. Always keep a fallback. Your mandatory statutory consumer rights are not affected.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost recordings, performances, data, time, or revenue, arising from your use of or inability to use the app. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for death, personal injury, or fraud).
8. Privacy
Your use of the app is also governed by our Privacy Policy.
9. Changes
We may update these Terms; the current version is always posted at this URL with the date above. Continued use after a change means you accept it.
10. Governing law
These Terms are governed by the laws of the Republic of Latvia and applicable European Union law, without regard to conflict-of-laws rules. If you are a consumer, the mandatory consumer-protection rules of your country of residence still apply, and you may bring proceedings there.
